29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New townhome construction located on Lot #20, Roof: On or about 12/15/2017, and at times prior, the employer exposed employees to fall hazards on a 5/12 pitched roof at heights of 22-feet, 2-inches from the lower level, in that a fall protection system was not provided to employees engaged in sheathing activities. (b) New townhome construction located on Lot #20 and Lot #22, Second level: On or about 12/25/2017, and at times prior, the employer exposed employees to fall hazards of 13-feet to the lower level, in that employees working near window rough openings were not protected from falls to the lower level as top guard rails were not installed. Faustino Galvan DBA Faustino Galvan Construction, LLC was previously cited for a violation of this occupational saety and health standard or it's equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 976577, citation number 1, item number 1 and was affirmed as a final order on 06/24/2014, with respect to a workplace located at 155 Humboldt Drive, Fayetteville, GA 30214.
