29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) Old Blue Hen Shopping Mall, Dover, DE - On or about August 26, 2017, the employer failed to provide effective information and training related to the hazardous chemicals handled in the workplace, including but not limited to, the hazards related to the caustic properties of Portland Cement.

29 CFR 1904.39(a)(2): Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a) Old Blue Hen Shopping Mall, Dover, DE - On or about August 26, 2017, the employer failed to report the hospitalization of an employee who sustained chemical burns resulting from exposure to Portland Cement without the use proper personal protective equipment. A report of this incident was not received by OSHA until August 29th, 2017.
