29 CFR 1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, the employer shall retrain the affected employee. Construction Site: On or about August 31, 2017 employees were observed engaged in roofing activities without the proper use of fall protection demonstrating inadequacies in the employees knowledge of fall protection. This condition exposed employees to a fall hazard of greater than six feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: Construction Site: On or about August 31, 2017, employees were observed working on a residential construction without the use of proper fall protection equipment. This condition exposed employees to fall hazards greater than 6-feet to the ground below. Hernandez Roofing was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 950087, citation number 2, item number 1 and was affirmed as a final order on April 22, 2014, with respect to a workplace located at 4564 Stanton, El Paso, TX 79912.
