29 CFR 1926.451(e)(9)(iii): When erecting or dismantling tubular welded frame scaffolds, (end) frames, with horizontal members that are parallel, level and are not more than 22 inches apart vertically may be used as climbing devices for access, provided they are erected in a manner that creates a usable ladder and provides good hand hold and foot space. a. On or about September 6, 2017, located at the site in New Albany, Ohio, employees were dismantling a fabricated frame scaffold while on the fifth buck and used the frame of the scaffolding to ascend and descend the scaffolding exposing the employees to a maximum fall hazard of approximately 32 feet.

29 CFR 1926.451(e)(9)(iv): Cross braces on tubular welded frame scaffolds shall not be used as a means of access or egress. a. On or about September 6, 2017, located at the site in New Albany, Ohio, employees were dismantling a fabricated frame scaffold while on the fifth buck and used the crossbracing to climb down to the fourth buck, thereby exposing the employees to a fall hazard of approximately 6 feet, 7 inches.

29 CFR 1926.451(g)(2): Effective September 2, 1997, the employer shall have a competent person determine the feasibility and safety of providing fall protection for employees erecting or dismantling supported scaffolds. Employers are required to provide fall protection for employees erecting or dismantling supported scaffolds where the installation and use of such protection is feasible and does not create a greater hazard. a. On or about September 6, 2017, located in New Albany, Ohio, employees were dismantling fabricated frame scaffolding on the top of the fourth buck. Employees were required to access a ladder on the top of the 3rd buck while there were no guardrails between frames on the eastern side to protect the employees from a fall, thereby exposing the employees to a fall hazard of approximately 25 feet. b. On or about September 6, 2017, located in New Albany, Ohio, employees were dismantling fabricated frame scaffolding on the top of the fourth buck. Employees were required to access a ladder on the top of the 3rd buck while there were no midrails across three openings between frames to protect the employees from a fall, thereby exposing the employees to a fall hazard of approximately 25 feet.
