NOTE: Construction Reference: 1926.59 The requirements applicable to construction work under this section are identical to those set forth at � 1910.1200 of this chapter. 29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: a) On August 31, 2017, the employer did not provide employees with the details of the hazard communication program developed to comply with 29 CFR 1910.1200, including an explanation of the workplace labeling , safety data sheets, and how to obtain and use hazard information. Employee(s) were exposed to hazardous, alkaline, Spec Mix and/or Essroc Brixment Type N masonry cement (pH > 13; contains hazardous crystalline silica) when laying bricks for a new building wall. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
