On or about September 7, 2017 and at times prior thereto, employees were using pneumatic nail guns without eye protection during framing construction of a residential apartment building. This condition exposed employees to stuck-by hazards.

This condition exposed employees to the hazard of falling to the ground below.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about September 7, 2017 and at times prior thereto, on a wood-framed residential building under construction, employees were exposed to falls while working at heights of greater than 6 feet without fall protection. This hazard exposed employees to the hazard of falling to the ground below. A. Employees were performing framing construction while on the second level of the frame without fall protection. B. Employees were performing framing construction on the third story of the frame in the vicinity of an unguarded opening without fall protection. C. An employee was performing framing construction while standing in the vicinity of the top plate on third story of the apartment complex without fall protection. Avila Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1006945, citation number 1, item number 1 and was affirmed as a final order on May 20, 2015, with respect to a workplace located at 1200 Brookwood Drive, Little Rock, Arkansas. Avila Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 991158, citation number 1, item number 1 and was affirmed as a final order on May 20, 2015, with respect to a workplace located at 1200 Brookwood Drive, Little Rock, Arkansas.
