OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards when utilizing damaged steel storage racks: a) Freezer Storage Area - On or about September 15, 2017, the employer did not ensure that the four level storage rack system with multiple bays used to store pallets of materials weighing 972-1510 lbs., displayed plaques with rated loads (1.4.2 plaque); b) Freezer Storage Area - On or about September 15, 2017, the employer did not ensure that the steel storage racks with visible damage were immediately isolated until the damaged portions were evaluated by a storage rack design professional and were not placed back into service until repaired and certification was obtained that the repaired components of the storage rack system were restored to at least their original design capacity (1.4.9 rack damage); Employees were exposed to struck-by and/or crush-by hazards while working in and around the damaged storage rack system. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.178(p)(1): Powered industrial truck found to be in need of repair, defective, or in any way unsafe, were not taken out of service until it has been restored to safe operating condition: a) Shipping and Receiving Area - On September 15, 2017, the employer did not ensure the Crown Sit-Down Forklift, model #SC4520-35, serial #464789, which had a damaged front operator wheel, was removed from service until repairs could be made. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET). b) Shipping and Receiving Area - On September 15, 2017, the employer did not ensure the Crown Stand-Up Forklift, model #RMD6025-32, serial #1A412566, which had a damaged rear strobe light, was removed from service until repairs could be made. No abatement certification or documentation is required for this item. c) Shipping and Receiving Area - On September 15, 2017, the employer did not ensure the Crown Sit-Down Forklift, model #SC5215-30, serial #9A184614, which had a damaged front right light, was removed from service until repairs could be made. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
