29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a. On or about September 7, 2017, at the site located at 1245 Lenox Court, Lewis Center, Ohio, an employee was installing a window from the lower level roof of a two story residential home with a pitch of approximately 6 in 12 and approximately 10 feet in height without fall protection, thereby exposing the employee to a fall hazard. Miguel Saldana was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1005171, citation number 1, item number 1 and was affirmed as a final order on December 18, 2014, with respect to a workplace located at 4525 Ackerly Farm Rd, New Albany, Ohio 4305.
