29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) American Modern Exteriors, LLC failed to provide documentation demonstrating the abatement method and completion of the following items as cited:      a) Citation 1, Item 1: Establish and maintain a program to address job site safety and health and provide a competent person to address recognized hazards for workers.     b) Citation 1, Item 2: Ensure that fall protection is provided and utilized during construction work at heights greater than 6 feet.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On or about September 21, 2017 at 3209 East Main Street in Merrill, WI, employees were exposed to multiple hazards, including but not limited to, falls from elevated surfaces and ladders, struck by flying objects, fire, and amputations, while re-roofing a two story hotel building when the employer did not conduct inspections to identify and correct recognizable hazards and/or to enforce personal protection equipment use.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.  On or about September 21, 2017 at 3209 East Main Street in Merrill, employees were working in a roof surface 17 ft. above surface level without utilizing any fall protection equipment.
