29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: Icon Construction Site: On or about September 21, 2017, two employees were observed working on the top plates of framed walls and truss members without any type of fall protection equipment. This condition exposed employees to a fall hazard of more than 6-feet to the ground below.

29 CFR 1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, the employer shall retrain the affected employee: Icon Construction Site: On or about September 21, 2017, two employees were observed working on the top plates of framed walls and truss members without utilizing any type of fall protection equipment. The employer did not provide a training program to enable employees to recognize the hazards of falling. This condition exposed employees to a fall hazard of more than 6-feet to the ground below.
