29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    Site- Employees operating pneumatic nail guns were not protected from eye injuries where the employer did not ensure that eye protection was worn.

29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level:    Lot 5 and 6- Employees working from the second floors were not protected from a fall of approximately 13 feet to the exterior grade where window openings with a sill height of 25 inches did not have a top rail.

Lot 5- Employees were not protected from a fall hazard where the employer did not provide a ladder or ramp to access the first floor at the front entrance where the break in elevation from exterior grade was approximately 36 inches.    b. Lot 5- An employee was not protected from a fall hazard where a ladder was not utilized to access a window sill to stand on while framing. The break in elevation from the first floor to the window sill was 25 inches.
