OSH ACT of 1970 Section (5)(a)(1): Public Law 91-596, the Occupational Safety and Health Act of 1970, Section 5(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to his employees, in that employees were exposed to a fall hazard: (a) Barnes Street, Opp AL - On September 14, 2017, and times prior, employees were exposed to fall hazards while riding on the tailgate of a pick-up truck on an open street to transport construction debris. One employee was sitting on the tailgate of the truck with no restraining device to prevent the employee from falling off the truck.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours. a) 800 Barnes Street Opp AL; On or about September 14, 2017 the employer had an employee fall from a bed of a pick-up truck and strike his head resulting in an in-patient hospitalization. The employer failed to report the work-related hospitalization to OSHA within twenty-four (24) hours.
