OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was exposed to stuck by hazards while using a rack lifting jack:  a.  On or about September 29, 2017, at the above addressed jobsite, an employee was repairing an upright on a Mecalex teardrop style racking system, using a Worldwide Material Handling Rack Lifting Jack with materials loaded on the rack that exceeded the jack's 10,000 pound rated lifting capacity.  In accordance with 29 CFR 1913.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition documentation demonstrating that abetment is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the training on the safe handling of the rack repair system equipment.
