29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) King Soopers at 10351 Federal Blvd, Westminster, CO: On or before September 28, 2017, the employer did not ensure all forklift operators were trained in operation of powered industrial trucks, in that the operators were not trained in the use of Crown WP 2300 Walkie Pallet Truck Forklifts and Hyster W30ZR Walkie Reach Forklifts prior to their use. On September 10, 2017 an employee sustained a foot amputation injury while operating a powered industrial truck. This condition exposed employees to struck-by hand other hazards. Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: (a) King Soopers at 10351 Federal Blvd, Westminster, CO: On or before September 28, 2017, the employer did not evaluate the forklift operators at least once every three years. Employees have operated Crown WP 2300 Walkie Pallet Truck Forklifts and Hyster W30ZR Walkie Reach Forklifts for up to approximately four years but were not evaluated for forklift performance. On September 10, 2017 an employee sustained a foot amputation injury while operating a powered industrial truck. This condition exposed the employees to the hazards to struck-by and other hazards.
