29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    Located on the north side of a residential structure, an employee was operating a National Series 900 Telescopic Crane that had not been trained on the recognition and avoidance of unsafe conditions such as electrical power line clearance in that on September 30, 2017 the rigger received an electrical shock when the cranes wire rope made contact with the power lines of 7,200 KV.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.1408(a)(2): Determine if any part of the equipment, load line or load (including rigging and lifting accessories), if operated up to the equipment's maximum working radius in the work zone, could get closer than 20 feet to a power line.    On September 30, 2017 prior to beginning of a crane operation lift, the employer did not determine if any part of the National Series 900 Telescopic Crane could get closer than 20 feet to the power lines in that the Rigger received an electrical shock when the cranes wire rope made contact with power lines of 7,200 KV.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.1413(a)(4)(iii): If a deficiency in Category III is identified, operations involving use of the wire rope in question must be prohibited until the wire rope is replaced.    On September 30, 2017, a National Series 900 Telescopic Crane was not removed from service after the cranes wire rope made contact with a power line in that the employer did not remove and replaced the wire rope after making contact with the power line.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.1413(a)(4)(iv): Where a wire rope is required to be removed from service under this section, either the equipment (as a whole) or the hoist with that wire rope must be tagged-out, in accordance with 1926.1417(f)(1), until the wire rope is repaired or replaced.     On and after September 30, 2017, the employer continued to operate a National Series 900 Telescopic Crane after the cranes wire rope made contact with power line in that the employer did not tagged-out the crane or wire rope to prevent operation of the crane until the wire rope was replaced.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.1412(f)(1): At least every 12 months the equipment must be inspected by a qualified person in accordance with paragraph (d) of this section (each shift) except that the corrective action set forth in paragraphs (f)(4), (f)(5), and (f)(6) of this section must apply in place of the corrective action required by paragraphs (d)(2) and (d)(3) of this section.    On September 30, 2017 located on the north side of a residential construction site, the employer failed to perform an annual inspection by a qualified person of a National Series 900 Telescopic Crane used during a framing operation.    The Garrison Crane Service was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1412(f)(1), which was contained in OSHA inspection number 1221998, citation number 1, item number 2 and was affirmed as a final order on 6/26/17, with respect to a workplace located at 7228 Glenview Farm Dr., Hamilton, OH 45011.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
