29 CFR 1926.1402(b): The equipment must not be assembled or used unless ground conditions are firm, drained, and graded to a sufficient extent so that, in conjunction (if necessary) with the use of supporting materials, the equipment manufacturer's specifications for adequate support and degree of level of the equipment are met. The requirement for the ground to be drained does not apply to marshes/wetlands. On July 12, 2018 a National Series 900 telescopic crane was utilized to lift roof trusses onto the residential structure. the ground conditions were not graded to provide adequate support and degree of level of the crane, in that two of the five outriggers were not making contact with the ground.

29 CFR 1926.1408(a)(2): Determine if any part of the equipment, load line or load (including rigging and lifting accessories), if operated up to the equipment's maximum working radius in the work zone, could get closer than 20 feet to a power line. If so, the employer must meet the requirements in Option (1), Option (2), or Option (3) of this section, as follows: On July 12, 2018 prior to beginning of a crane operation lift, the employer did not determine if any part of the National Series 900 telescopic crane could get closer than 20 feet to the power lines, in that the rigger was electrocuted when the cranes load line made contact with power lines of 7,200 KV. Garrison Crane Service was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1408(a)(2), which was contained in OSHA inspection number 1267847, citation number 1, item number 2 and was affirmed as a final order on December 4, 2017, with respect to a workplace located at 8000 Remington Rd., Cincinnati, OH 45213.
