Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from sections of the tree being cut: a) Employees were exposed to a struck-by hazard from cut sections of a tree that were being lifted and moved by a crane with the use of steel alloy chain slings. The employees attaching the chain slings had not been trained on the proper rigging of tree sections with the steel alloy chain slings, on or about October 14, 2017.

29 CFR 1910.184(c)(6): Slings were not securely attached to their loads: a) An approximately 4000 pound tree section came out of a chain sling and rolled over an employee while he was in an aerial lift 2 feet away from the tree, on or about October 14, 2017.
