Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest systems. On 10/05/2017, employees from Fregalette Construction, LLC were installing a gutter board and sheathing on roof of a residential building located on lot 329 Luxembourg Gardens Court in Wentzville, MO. They were not utilizing guardrail systems, a safety net system, or personal fall arrest systems. The foreman and the employee were observed walking on the top plate of the second story exterior wall approximately sixteen to eighteen feet above the ground without fall protection, exposing them to a fall to the ground below.

On 10/05/2017, employees from Fregalette Construction, LLC were installing a gutter board and sheathing on roof of a residential building located on lot 329 Luxembourg Gardens Court in Wentzville, MO. The foreman and employee used the stairway in the home to access the second level to gain access to the roof. The stairway did not have a stairrail system along the unprotected side of the stairway.
