29 CFR  1926.501(b)(4)(i):  Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  On 5/10/2022, employees from Fregalette Construction, LLC were not protected from falling through a floor opening by use of a personal fall arrest system, a cover, or guardrail system on the first floor of a residential building located at 400 Amberleigh Manor Dr. located in Wentzville, MO.  The floor opening was 9 feet to the lower level.

29 CFR  1926.501(b)(14):  Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  On 5/10/2022, employees from Fregalette Construction, LLC were constructing interior walls on the second story of a residential building located at 400 Amberleigh Manor Dr., Wentzville, MO.  Employees were working near the window openings which were approximately twelve feet above the ground.  The employees were not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system.  On 5/10/2022, employees from Fregalette Construction, LLC were constructing interior walls on the second story of a residential building located at 400 Amberleigh Manor Drive in Wentzville, MO. The foreman was observed accessing the first-story roof through a second-story window opening to retrieve building material 10 feet above the ground without utilizing guardrail systems, safety net system, or personal fall arrest system.  Fregalette Construction, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926. 501(b)(13), which was contained in OSHA inspection number 1270933, citation number 1, item number 3, issued on 10/24/2017, and was affirmed as a final order on 11/9/2017, with respect to a workplace located at a residential building located on lot 329 Luxembourg Gardens Court in Wentzville, MO.

On 5/10/2022, employees from Fregalette Construction, LLC were constructing interior walls on a residential building located at 400 Amberleigh Manor Dr. Wentzville, MO.  The foreman and three employees used the stairway in the home to access the second level.  The stairway did not have a stairrail system along the unprotected side of the stairway.  Fregalette Construction, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.1052(c)(1)(ii), which was contained in OSHA inspection number 1270933, citation number 2, item number 1, group a issued on 10/24/2017, and was affirmed as a final order on 11/9/2017, with respect to a workplace located at a residential building located on lot 329 Luxembourg Gardens Ct, Wentzville, MO.

The foreman and three employees used the stairway in the residential building to access the second level.  The stairway landings were not provided with guardrail systems.  Fregalette Construction, LLC was previously cited for a violation of a similar occupational safety and health standard 29 CFR 1926.1052(c)(12), which was contained in OSHA inspection number 1270933, citation number 1, item number 2, group b issued on 10/24/2017, and was affirmed as a final order on 11/9/2017, with respect to a workplace located at a residential building located on lot 329 Luxembourg Gardens Ct, Wentzville, MO.
