29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): a). On or about 10/17/17, on site, where employees are handling Patinas and various chemicals. The Patinas and chemicals handled by the employee included Patina Green Verde #444, Antique Brown M38, and Cleaner 104. The Patinas and chemicals contain chemicals such as, but not limited to, Phosphoric Acid and Sulfuric Acid. The acids are corrosive. The employer did not conduct an assessment to select rubber gloves and require them; as well as to ensure employees don arm sleeves when handling the Patinas and chemicals and select a rubber apron.

29 CFR 1910.138(a): The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasion; punctures; chemical burns; thermal burns; and harmful temperature extremes: a). On or about 10/17/17, on site, where employees are handling Patinas and various chemicals. The Patinas and chemicals handled by the employee included Patina Green Verde #444, Antique Brown M38, and Cleaner 104. The Patinas and chemicals contain chemicals such as, but not limited to, Phosphoric Acid and Sulfuric Acid. The acids are corrosive. The employer selected and required the use of latex gloves. Latex gloves would not protect against corrosives like rubber gloves.

The Patinas and chemicals handled by the employee included Patina Green Verde #444, Antique Brown M38, and Cleaner 104. The Patinas and chemicals contain chemicals such as, but not limited to, Phosphoric Acid and Sulfuric Acid. The acids are corrosive. SA BAXTER WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL AND SAFETY AND HEALTH STANDARD, 1910.151(c), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 991405, CITATION NUMBER 01, ITEM NUMBER 001a, ISSUED ON 1/8/2015 AND WAS AFFIRMED AS A FINAL ORDER ON 01/14/2015.
