29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:          Maintenance:  The employer did not develop a written hazard communication program as required.  Employees use chemical products such as flammable paints,  thinners, and gasoline, cleaning products, and chlorinated pool chemicals.  Some safety data sheets (SDSs) are available.  At a minimum, the employer needs to prepare:       1. A list of chemical products used;  2. A complete collection of Safety Data Sheets;       3. Develop a written training and information program for employees;      4. Address the labeling system that will be used in the workplace.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:                        Maintenance:  Employees were not trained on the new label elements (e.g., pictograms and signal words) and the new SDS formation by December 2, 2013, as required by the revised Hazard Communication Standard.  Employees use hazardous chemicals such as but not limited to chlorinated pool maintenance chemicals, flammable paints, thinners, gasoline, and corrosive muriatic acid.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2):   Maintenance/Housekeeping: The employer has provided employees with personal protective equipment (PPE) such as gloves, aprons, and eye and face protection, to be worn when performing maintenance and housekeeping duties such as mixing and applying cleaning products, adding pool chemicals, and bush cutting.  The use of PPE is a job requirement.  A written hazard assessment was not available that included the following elements:                        1.  Select and have each affected employee use the types of PPE that will protect them from the hazards identified in the hazard assessment;  2.  Communicate the selection decisions to each affected employee and;  3.  Select PPE that properly fits each affected employee.
