29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    (a)Jensen Masonry, Inc. at 707 W. 4th Street, Sioux Falls, SD 57105: On or about and at times prior to October 23, 2017, the exposing employer did not ensure that the forklift operator had been trained and evaluated as required by 29 CFR 1910.178(l) in the topics as outlined in 29 CFR 1910.178(l)(3). An employee operated a rough terrain forklift to provide materials to the Hydro-Mobile M-2 Mast Climbing Work Platforms without the proper training. Employees were not provided the practical portion of the training. This condition exposed employees to struck-by hazards and improper operation of the forklift.       Abatement Note:  The certification shall include:       (1)  The name of the operator;   (2)  The date of the training;   (3)  The date of the evaluation; and,   (4)  The identity of the person(s) performing the training and evaluation.       Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.     Abatement Note: The requirements applicable to construction work under 1926.602(d) are identical to those set forth at 1910.178(l) of this chapter.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):         (a)Jensen Masonry, Inc. at 707 W. 4th Street, Sioux Falls, SD 57105: On or about and at times prior to October 23, 2017, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards while working on a roof and on the Hydro-Mobile M2 Mast Climbing Work Platforms. This condition exposed employees to a fall hazard of approximately 20 feet to the ground below from the Mast Climber and 14 feet while working from the roof.     Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.451(g)(1):  Each employee on a scaffold 10 feet above a lower level was not protected from falling to the lower level:     (a)Jensen Masonry, Inc. at 707 W. 4th Street, Sioux Falls, SD 57105: On or about and at times prior to October 23, 2017, the exposing employer did not ensure that employees were protected from fall hazards in that, adequate guardrails or other suitable fall protection systems were installed on the Hydro-Mobile M2 Mast Climbing Work Platforms. The mast climber located on the north end of the monastery under construction was missing guardrails on both ends of the platform. The mast climber was elevated above the adjacent mast climber located directly to the east, which exposed employees to fall hazards on the east end of the work platform. This condition exposed employees to a fall hazard of approximately 20 feet.

29 CFR 1926.451(b)(5)(i): Each end of a platform 10 feet or less in length shall not extend over its support more than 12 inches (30 cm) unless the platform is designed and installed so that the cantilevered portion of the platform is able to support employees and/or materials without tipping, or has guardrails which block employee access to the cantilevered end:  (a)Jensen Masonry, Inc. at 707 W. 4th Street, Sioux Falls, SD 57105: On or about and at times prior to October 23, 2017, the exposing employer did not ensure that an employee was protected from falling due to failure of cantilevered planking located on the outriggers of the Hydro-Mobile M2 Mast Climber that extended approximately three feet past a structural support. An employee was working on the cantilevered portion of the planking to conduct masonry activities. This condition exposed employees to a fall hazard of approximately 20 feet.

29 CFR 1926.454(a):  The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards:     (a)Jensen Masonry, Inc. at 707 W. 4th Street, Sioux Falls, SD 57105: On or about and at times prior to October 23, 2017, the exposing employer did not have each employee who performs work while on a scaffolds trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffolds being used and to understand the procedures to control or minimize those hazards. Employees were conducting masonry activities while working on a Hydro-Mobile M2 Mast Climber system without being trained by a qualified person. This condition exposed the employees to a fall of approximately 20 feet.    Abatement Note: The training shall include the following elements at a minimum:     (1)The nature of any electrical hazards, fall hazards, and falling object hazards in the work area;     (2)The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used:     (3)The proper use of the scaffold, and the proper handling of materials on the scaffold;     (4)The maximum intended load and the load-carrying capacities of the scaffold used; and     (5)Any other pertinent requirements of this subpart.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.     (a)Jensen Masonry, Inc. at 707 W. 4th Street, Sioux Falls, SD 57105: On or about and at times prior to October 23, 2017, the exposing employer did not ensure each employee engaged in masonry construction were trained to recognize the hazards of working at elevation and trained in the use of fall protection. An employees was engaged in masonry activities on a single-story roof adjacent to the mast climber without the use of a fall protection system. This condition exposed employees to a fall in excess of 14 feet.       Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:       a)The nature of fall hazards in the work area;   b)The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;   c)The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;   d)The role of each employee in the safety monitoring system when this system is used;   e)The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;   f)The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and   g)The role of employees in fall protection plans;   h)The standards contained in this subpart.       Abatement Note:  Abatement certification is required for this item (see enclosed Abatement-Certification Letter").       Abatement Note: 1926.503(b)(1) provides that the employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.
