29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles: (a)Jensen Masonry, Inc. at 1 Bulldog Avenue, Baltic, SD 57003: On or about and at times prior to July 11, 2023, the exposing employer did not ensure that each employee that was cutting cement masonry block on a commercial property with the use of a hand held Milwaukee 14-inch Concrete Saw, model number: MXF314-0, serial number: K26AD194103000, was protected from flying particles by the use of appropriate eye and face protection. This condition exposed employees to eye and face hazards from saw kickback/deflection and debris/dust generated by operation of the concrete saw.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii): (a)Jensen Masonry, Inc. at 1 Bulldog Avenue, Baltic, SD 57003: On or about and at times prior to July 11, 2023, the employer did not ensure all working levels of a Hydro-Mobile scaffold system was fully planked. Employees conducting masonry activities were exposed to working surface openings greater than 20-inches adjacent to the point of ladder access and egress while the ladder was not in use. This condition exposed employees to fall hazards greater than 10 feet.
