OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential fire, explosion, and deflagration hazards.    a) In the tower dryer system, on or about 10/25/17: Equipment such as, but not limited to the dryer, cyclones, ducts, and bagging dust collector contained potentially explosive atmospheres during normal operations while handling combustible powdered products. The employer did not ensure that the equipment was equipped with a means of protection to prevent explosion and deflagration.    b) In the V-bottom dryer system, on or about 10/25/17: Equipment such as, but not limited to the dryer, cyclones, and ducts contained potentially explosive atmospheres during normal operations while handling combustible powdered products. The employer did not ensure that the equipment was equipped with a means of protection to prevent explosion and deflagration.     c) On the baghouse of the V-bottom dryer system, on or about 10/25/17: Explosion vent panels on the baghouse were designed to release indoors in the penthouse.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:      a) By the Tower and V-bottom dryers, on or about 12/21/17: Employees who worked around equipment in the dryer systems where potential explosion and flash fire hazards existed did not wear flame resistant clothing.       b) In and around the Tower Dryer, On or about 10/25/2017:  Employees were exposed to steam pipes and were not provided with clothing to prevent burns.  An alternative abatement would be to insulate the exposed steam lines.
