29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:      a) On or about 10/31/17, on the roof of a 3-story commercial building at 128 Walnut St., Lockport, NY: Employees engaged in the installation of a replacement roof on the high flat roof and low slope dormers of the building were exposed to a fall of approx. 25 ft.  No fall protection system was being used       NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system:    a) On or about 10/31/17, on the site of  a 3-story commercial building at 128 Walnut St., Lockport, NY: A fire escape stairway that had the bottom end cut off and hanging 7 ft. above the ground was used by employees to access and exit the lower roof in the rear of the building. Employees were exposed to a 7 ft.  fall while accessing & exiting that staircase. In fact one employee actually  jumped off the bottom of the staircase to the ground. No fall protection was provided to prevent employees from falling off the end of the fire escape stairway.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:      a) On or about 10/31/17, on the site of a 3-story commercial building at 128 Walnut St., Lockport, NY:  In order to access the upper roof, employees  walked  to the end of the lower roof on the back side of the building where an extension ladder had been set up to access the upper roof, and climbed up that ladder.  The siderails of that extension ladder were  approx.  24 inches above the upper roof.       NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:      a) On or about 10/31/17, on the site of a 3-story commercial building at 128 Walnut St., Lockport, NY: Employees climbed  a 6 ft. stepladder set on the ground, and used  the top step and top of the stepladder as a step in order to grab onto the bottom of a fire escape stairway that had been cut off and was hanging 7 ft. above the ground. They also used the top step and top of the stepladder as a step in order to exit the fire escape stairway.       NO ABATEMENT CERTIFICATION REQUIRED
