OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) At 1799 West Beach Blvd., Gulf Shores, Alabama: On or about November 1, 2017 and at times prior; the employer exposed employees to fall of up to 30 feet in that employees were allowed to work off of a sheet of plywood elevated by a powered industrial truck without fall protection.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): In Reference: 29 CFR 1910.178(l)(1)(i): At 1799 West Beach Blvd., Gulf Shores, Alabama: On or about November 1, 2017 and at times prior; the employer allowed his employees to operate a powered industrial truck on site without first ensuring those employees were trained on the safe operations of the vehicle exposing his employees to struck-by and fall hazards.
