29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: a) At 1521 West Beach Blvd, Gulf Shores, Alabama: On or about February 13, 2019 and at times prior; the employer failed to ensure employees working from an aerial lift were wearing a harnesses and tied off exposing his employees to a fall hazard of up to 30 feet to the ground below. THE CODY BARNETT DBA CODY BARNETT WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.451(C)(2)(IV) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1360750, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON FEBRUARY 4, 2019, WITH RESPECT TO A WORKPLACE LOCATED AT 1521 WEST BEACH BLVD., GULF SHORES, ALABAMA.
