29 CFR 1926.501(b)(14): "Wall openings." Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. a) 5089 Rapahoe Trail, Lot 259, Roof & Second floor wall opening; On or about 11/03/2017, and at times prior the employer exposed an employee to falls of 11 feet while performing framing work next to a 6 foot by 6 foot wall opening, in that fall protection was not being used.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a) 5089 Rapahoe Trail, Ladders; On or about 11/03/2017 and at times prior the employer exposed two employees to falls of 11 feet while accessing the second floor of a two story residential dwelling to perform framing activities, in that the extension ladders were not fastened at the top and only extended 1 ½ feet above the landings.
