29 CFR 1926.102(a)(1):Eye and face protective equipment were not used when machines or operations presented potential eye or face injury: a) New residential construction; Lot 28; Roof: On or about 9/2/2021, the employer exposed an employee installing sheathing to struck-by hazards, in that he was operating a Matebo NR83A5 framing nail gun at 120 PSI without eye protection.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction; Lot 28; Roof: On or about 9/2/2021, and at times prior, the employer exposed employees to fall hazards, in that a complete fall protection system was not provided to employees who were installing sheathing on the second story of a 12:12 pitch roof at heights measured over 25 feet to the lower level. Monroy Framing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR1926.501(b)(13), which was contained in OSHA inspection number 1262282, citation number 1, item number 1 and was affirmed as a final order on 10/30/2017, with respect to a workplace located at 7347 Demeter Dr. Atlanta, GA. 30349.
