29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): On or about November 8, 2017, employees were exposed to a cave-ins while installing new water lines and hydrants in a trench that was measured to be approximately 6 feet in depth. No cave-in protection was utilized by the employer. Underground Utilities, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(a)(1), which was contained in OSHA inspection number 980941, citation number 1, item number 2 and was affirmed as a final order on July 16, 2014, with respect to a workplace located at Washington Park 4th Street, Lorain, Ohio 44052.

29 CFR 1926.652(b)(3)(iii): Tabulated data, identifying the registered professional engineer who approved the data, was not maintained at the jobsite during construction of the protective system. After that time, that data was not made available to the Secretary when requested: On or about November 8, 2017, the employer failed to maintain at the jobsite a copy of the tabulated data during the construction of the protective system to be used in a trench that was measured to be approximately 6 feet in depth. No tabulated data was located on the box and the employer provided a photo of an illegible label on the protective system.
