OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) from caught-in and amputation hazards:    The employer is failing to protect employee(s) from caught-in and amputation hazards when operating the AccurPress (model # 417512, serial # 10484) hydraulic press brake.  This was most recently documented on or about 11/8/2017 and at times prior in the welding and fabrication shop located at 1520 25th Street, Columbus, NE 68601 while employee(s) were operating an unguarded AccurPress hydraulic press brake to fabricate small quantity runs of custom-made piece parts, without the use of provisions to protect employee(s) from the point of operation hazards created by the closing dies.    Amongst other methods, some feasible and acceptable abatement methods to minimize this hazard may include, but are not limited to the following:    1.  Where not feasible to install physical guards, ensure all operating and helping employee(s) approach the point of operation no closer than necessary as described in paragraph 6.1.4.3 of ANSI B11.3-1982 standard for safeguarding of power press brakes, and maintain a safe distance of no closer than 4 inches to the point of operation.  2.  Where electing to safeguard by distance from the point of operation, develop and document a "safe distance" exposure prevention procedure and ensure its utilization by employee(s) operating the powered press brake.  3.  Where electing to safeguard by distance from the point of operation, train employee(s) operating power press brakes on the aforementioned safe distance procedure and at least the following:       a. The need for a safety oriented working relationship between the power press brake operator and when required, his or her helper.      b. The function and purpose of operating controls: operating mode controls; die space height adjustment positions: and other brake controls.      c. The hazards of placing any parts of the body within the point of operation.      d. The hazards and potential exposure related to each specific piece part bending operation particularly with respect to the piece part itself (for example, whipping) and to tooling (including loading and unloading).      e. The function and purpose of hand-feeding tools.      f. The dangers of unsafe work practices, inattention, horseplay, and misuse of equipment.      g. The necessity and importance of reporting immediately to the supervisor any condition concerning the power press brake and its operation that may affect the safety of an employee.  4.  Where electing to safeguard by distance from the point of operation, evaluate the effectiveness of the training and provided supervision along with periodic inspections to ensure only trained employee(s) are operating and assisting with use of the powered press brake, and that they follow the safe distance procedures.  In the event of any deviations or inadequacies in the procedure, promptly correct and retrain the affected employee(s).    OR IN THE ALTERNATIVE:    29 CFR 1910.212(a)(3)(ii): Points of operation of machinery were not guarded to prevent employees from having any part of their body in the danger zone during operating cycles:    The employer is failing to protect employee(s) from caught-in and amputation hazards when operating the AccurPress (model # 417512, serial # 10484) hydraulic press brake.  This was most recently documented on or about 11/8/2017 and at times prior in the welding and fabrication shop located at 1520 25th Street, Columbus, NE 68601 while employee(s) were operating an unguarded AccurPress hydraulic press brake to fabricate small quantity runs of custom-made piece parts, without the use of physical barriers or devices installed to protect employee(s) from the point of operation hazards created by the closing dies.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    The employer is failing to protect employees from struck-by hazards when employees operate the Toyota (model # 42-5FGU25, serial # 78100) and Nissan (model # JGJ02A30, serial # JGJ0202A301813) forklift trucks.  This was most recently documented at 1520 25th Street, Columbus, NE 68601 November 8, 2017 and at times prior when employees operated the forklifts without receiving either initial operator training and evaluation, or a refresher training and evaluation at least once every three years thereafter.

29 CFR 1910.1200(h)(3)(ii): Employee training did not include the physical and health hazards of the chemicals in the work area:    The employer is failing to train employees on the physical and health hazards of hexavalent chromium in work areas where the contaminant could be present.  This was most recently documented inside the welding and fabrication shop located at 1520 25th Street, Columbus, NE 68601 on or about November 8, 2017 and at times prior when employees performed tig welding of stainless steel metals.
