29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used: a) Tubular welded frame scaffold; On or about November 6, 2017 and at times prior thereto, the employer exposed his employees to fall hazards of up to 13 feet 6 inches to the ground below in that employees engaged in masonry activities were allowed to utilize the side supports of the scaffold to access/egress the scaffolding levels due to the employer failing to provide a ladder or other means of safe access.
