29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.    (a)J & R Construction, Inc. at 7916 Brande Circle, Sioux Falls, SD 57108: On and prior to November 9, 2017, the employer did not ensure employees were protected from injury, in that employees and the owner were conducting roof sheathing operations on a 6 in 12 pitched roof of a single-family home under construction. This condition exposed employees to a fall hazard of approximately 19 feet 8 inches.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)J & R Construction, Inc. at 7916 Brande Circle, Sioux Falls, SD 57108: On and prior to November 9, 2017, the employer did not ensure that each employee engaged in roof sheeting operations on a single-family home, had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet.  The condition exposed employees to the hazard of falling from an elevation of approximately 19 feet 8 inches.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:    (a)J & R Construction, Inc. at 7916 Brande Circle, Sioux Falls, SD 57108:  On and prior to November 9, 2017, the employer did not ensure that each employee that was using an eight foot step ladder to gain access to the truss webbing. This condition exposed employees to a fall hazard of approximately eight-feet.
