29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a)J & R Construction, Inc. at 8618 Orcutt Street, Sioux Falls, SD 57106: On or about and at times prior to April 13, 2026, the employer did not ensure that each employee that was conducting framing operations on a residential property with the use of a pneumatic nail gun were protected from flying particles by the use of appropriate eye protection.  This condition exposed employees to struck-by hazards.

This condition exposed the employees to fall hazards greater than six feet.

29 CFR  1926.1053(b)(13):The top or top step of a stepladder was used as a step:  (a)J & R Construction, Inc. at 8618 Orcutt Street, Sioux Falls, SD 57106: On or about and at times prior to April 13, 2026, the employer did not ensure that the 8-foot Louisville Fiberglass A-frame ladder, Model Number: FXS508 CrossXStep, the employees were using to access the upper landing surface of the floor joists of a multi-family residential building was installed and used correctly in that employees were permitted to stand on the top or top steps while it was setup in the the A-frame configuration. This condition exposed employees to fall hazards greater than six feet.

This condition exposed the employees to fall hazards.
