29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) Van Buskirk Construction, LLC at 6225 South Minnesota Avenue, Sioux Falls, SD 57104: On or about and at times prior to November 13, 2017, the employer did not ensure that each employee was protected from falls from heights in that employees were installing LVL's for a roof structure with one employee utilizing the top plate of an exterior wall with no fall protection in place. This condition exposed the employees to a fall hazard of approximately 16 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Van Buskirk Construction, LLC at 6225 South Minnesota Avenue, Sioux Falls, SD 57104: On and prior to November 13, 2017, the employer did not ensure employees were trained in recognizing fall hazards or trained in fall protection systems. Employees were installing LVL's on a commercial property and were not trained on the use of fall protection systems and/or hazards associated with the activity. This condition exposed employees to a fall hazard of approximately 16 feet 2 inches to the ground below.
