29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: (a)Van Buskirk Construction, LLC at 2215 South Lorraine Place, Sioux Falls, SD 57106: On or about and at times prior to July 19, 2024, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Subcontracted employees were conducting framing operations on a commercial property without the use of a fall protection system and a lack of use of eye protection while using pneumatic nail guns. This condition exposed subcontracted employees to a variety of hazards while working on site.

This condition exposed subcontracted employees to struck-by hazards.
