29 CFR 1910.176(a): Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a. At the workplace located at 35 Rix Mills Road, New Concord, Ohio, in the packaging department, permanent aisles and passageways were not marked in areas where there were pedestrian traffic, pallets of product staged, and powered industrial vehicles operating, thereby exposing employees to a struck-by hazard.

29 CFR 1910.178(l)(4)(i): Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely. a. On or about November 2, 2017, the employer did not provide refresher training and evaluation to an operator that was observed operating a forklift in an unsafe manner and involved in a near-miss incident prior to permitting the operator to continue operating the forklift.
