29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident: 1) Warehouse Area: On or about November 15, 2017, the employer exposed employees to struck-by hazards in that an employee operating the Hyster truck #90 FL16 model H90FT and serial 5005V03433M was involved in an accident on November 10, 2017 and was not provided refresher training.

29 CFR 1910.1200(h)(1): Employees were not provided information and training on hazardous chemicals or materials in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area: 1) Warehouse Area: On or about November 15, 2017, the employer exposed employees to a health hazards by not providing training to all employees on the new hazard communication standard Global Harmonized System (GHS) that took effective December 1, 2013. The employees were using the hazardous chemical on a daily basis, such as but not limited to propane, spray paint and hydraulic fluid.
