29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   The employer is failing to provide training to employees on the skills necessary to identify the hazards associated with working in and around trenches/excavations.  The most recent occurrence of this was evident on November 16, 2017 on the job site located at 5014 Pinkney St. Omaha, NE, where the employer had inadequately trained employees replacing the sewer pipes from the house to the road while working in a trench without shoring protection that was not inspected by a competent person prior to use.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:   The employer is failing to protect employees from caught between and struck by hazards associated trenching and excavations when the employer has failed to meet the requirements of having a competent person inspect the trench/excavation prior to employees entering.  The most recent occurrence of this was evident on November 16, 2017 on the job site located at 5014 Pinkney St. Omaha, NE, where the employer had inadequately trained employees replacing the sewer pipes from the house to the road while working in a trench without shoring protection that was not inspected by a competent person prior to use.
