OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards in areas where the concrete located on the exterior of multiple grain elevators were delaminating and spalling:    a. On or about September 12, 2017, outside of grain elevator bin 32, the employer did not protect employees from falling debris in that a large piece of concrete fell from the side of the elevator landing approximately five feet from the employee there by exposing employee to potential struck by hazard.    b. On or about September 12, 2017, on the new house dock, the employer did not protect employees from falling debris in that while an employee was cleaning up the area when a small pieces of concrete fell from the side of the grain elevator striking the employee on the shoulder.    c. On or about October 12, 2017, on the new house dock, the employer did not protect employees from falling debris in that while an employee was cleaning up the area when a small piece of concrete fell from the side of the grain elevator striking the employee on the mouth (lip).     Among other methods, one feasible abatement method is to install protective overhead work platform adjacent to all grain elevators where there is an employee access and construct barriers where delamination, spalling and water infiltration has occurred. The employer will maintain the overhead protection and barriers until repairs are completed and the areas have been deemed safe for employee occupation by a qualified professional.
