29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step. a) On or about November 16, 2017 and at times prior to, an employee stood on the top and top step(rung) of a 6-foot step ladder to come down from the second floor of a new building under construction, exposing the employee to a fall hazard of 9ft. 4ins.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system or personal fall arrest systems: a) On or about November 16, 2017 and at times prior to, employees were observed walking/working on the 2nd level of a new building under construction. The employees were not fall protected, exposing them to fall hazards from about 9 feet 4 inches to the ground below. I AND M GENERAL CONSTRUCTION, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(13) WHICH WERE CONTAINED IN OSHA INSPECTIONS NUMBER 1214142 CITATION NUMBER 1, ITEM NUMBER 1; NUMBER 1227442 CITATION NUMBER 2, ITEM NUMBER 2, AND WERE AFFIRMED AS FINAL ORDERS ON MARCH 18, AND MAY 11, 2017 RESPECTIVELY.
