29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms, and service rooms were not kept clean and orderly and in a sanitary condition: (a) Extruder 8 Area: On or about November 29, 2017 surfaces directly above the Number 8 Extruder including handrails, equipment, support beams, and exhaust ducts had an accumulation of combustible dust that posed an explosion, fire and/or deflagration hazard.

29 CFR 1910.178(c)(2)(vii): Power-operated industrial trucks designated as DY, EE, or EX were not used in atmospheres in which combustible dust is not normally in suspension in the air by normal operation of equipment or apparatus but where deposits or accumulations of such dust could be ignited by arcs or sparks originating in the truck: (a) Extruder 8 Area: On or about November 29, 2017 propane operated forklifts were used where combustible dust had accumulated on surfaces directly above the operating area of the forklifts such that if the dust accumulation became airborne it could be ignited by the forklift.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to combustible dust explosion, deflagration, or other fire hazards while working at or near a dust collection system which was not adequately designed to prevent or minimize employee exposure in the event of a deflagration or other uncontrolled fire event: (a) On or about November 29, 2017 the dust collector system that was connected to the indoor product silos was not designed with explosion prevention systems and/or explosion deflagration systems to prevent a combustible dust explosion and/or fire inside the bag house from propagating back through the exhaust duct into the workplace.
