29 CFR 1910.147(c)(7)(i): The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following: (a) The employer did not provide training that gave liquid machine operators the knowledge and skills required to safely remove and change out the dies, Teflon and remove jams. Specifically employees were not trained on the methods and means necessary for energy isolation.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: a) Employees who perform servicing and/or maintenance on the liquid machines were not required to: (1) know the type and magnitude of the energy, the hazard of the energy to be controlled, and the method or means to control the energy, (2) turn off and shut down the machines, (3) physically locate and operate the electrical disconnect and pneumatic disconnect in such a manner as to isolate the machine or equipment from the energy source. (4) affix a lockout or tagout device to the electrical disconnect and pneumatic disconnect. (5) prior to starting work on machines that have been locked out or tagged out, verify that isolation and deenergization of the machine or equipment have been accomplished.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. (a) On November 17, 2017 an employee was in the process of reaching up the chute of liquid department machine #11 to pull down condiment packets that where sticking when their finger was caught in the knife blade.

29 CFR 1910.147(c)(4)(ii)(B): The energy control procedures did not clearly and specifically outline the steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy. a) The employer did not design specific procedural steps for isolating the energy source (electric and pneumatic) for the filler machines when changing out Teflon, dies and removing jams.
