On Dec. 1, 2017, an employee was observed operating a JLG Gradall G9-43A Telescopic Forklift that had not received training required by this subpart.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    The employer did not provide a training program for employees working on a commercial floor structure that were not trained to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. The employees were performing framing work at a fall height greater than 25 feet (above the ground below) and 10 feet (to next lower level).

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On Dec. 1, 2017, located on the south end of a commercial floor structure, there were no frequent and regular inspections being performed by a competent person to ensure the jobsite, materials and equipment such as fall protection systems and/or devices were being maintained and utilized in a safe condition.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    (A) On Dec. 1, 2017, located on the south side of a commercial structure, employees were observed performing framing work on a third story floor structure while not utilizing a fall protection system. Potential fall heights were measured to be greater than 25 feet (above the ground below) and 10 feet (to the next lower level).    (B) On or about Nov. 27, 2017, located on the south side of a commercial structure, employees were observed performing framing work on a third story floor structure while not utilizing a fall protection system. Potential fall heights were measured to be greater than 25 feet (above the ground below) and 10 feet (to the next lower level).

29 CFR 1926.502(d)(11): Lifelines shall be protected against being cut or abraded.     On Dec. 1, 2017, located on the south side of a commercial floor structure, an employee was observed utilizing a 50 foot vertical lifeline, as a lanyard, that had one end which was not protected against being cut or abraded. The snaphook end of the lanyard was tied back into itself on the nearest top plate while performing framing work. Potential fall heights were approximately 25 feet (to ground below) and 10 feet (to next lower level).

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    On Dec. 1, 2017, located inside the south end of a commercial structure, employees were observed using a 20 foot portable extension ladder that did not extend at least 3 feet above the second floor landing surface.

On Dec. 1, 2017, located inside the south end of a commercial structure, employees were observed using a 20 foot portable extension ladder which had the bottom end positioned against the horizontal bottom plate; and obstructed by the vertical wall studs; of a framed interior wall.
