29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems or personal fall protection systems such as personal fall arrest, travel restraint or positioning systems.     In the alternative:    29 CFR 1910.28(b)(1)(ii): When the employer can demonstrate that it is not feasible or creates a greater hazard to use guardrail, safety net, or personal fall protection systems on residential roofs, the employer must develop and implement a fall protection plan that meets the requirements of 29 CFR 1926.502(k) and training that meets the requirements of 29 CFR 1926.503(a) and (c).      Location - Roof of 45 Bacon St, Winchester, MA    On November 22, 2017, employees performing gutter cleaning on roofs greater than 9-feet above lower levels were not protected from falling.  Employees were working on the lower roof facing Ginn St, as well as the main and other roofs of the house.        Employees were cleaning gutters at the two story residence at 45 Bacon St., Winchester, MA, 01890, without fall protection.  Employees were also without nott following a fall protection plan that met the requirements of 29 CFR 1926.502(k).  Employees were exposed to falls of over nine-feet and up to 20 above the ground, while walking/working on 6:12 pitch roofs.      Ned Stevens was previously cited for a violation of this occupational safety and health standard or its equivalent standard 23(c)(1), 1910.132(a) or Section 5(a)(1) of the OSH Act, which was contained in OSHA inspection number 1134640, citation number 1, item number 1 and was affirmed as a final order on 1/27/2017, with respect to a workplace located at 89 Sykes Ave, Livingston, NJ 07039.      Ned Stevens was previously cited for a violation of this occupational safety and health standard or its equivalent standard 23(c)(1), 1910.132(a) or Section 5(a)(1) of the OSH Act, which was contained in OSHA inspection number 951897, citation number 1, item number 2 and was affirmed as a final order on 2/5/2015, with respect to a workplace located at 14 Grecian Street, Parsippany, NJ.      Ned Stevens was previously cited for a violation of this occupational safety and health standard or its equivalent standard 23(c)(1), 1910.132(a) or Section 5(a)(1) of the OSH Act, which was contained in OSHA inspection number 950211, citation number 1, item number 2 and was affirmed as a final order on 2/5/2015, with respect to a workplace located at 133 Riverview Avenue, North Arlington, NJ. 29 CFR 1910.23(c)(11): The employer did not ensure that portable ladders used to gain access to an upper landing surface had side rails that extended at least 3 feet above the upper landing surface.     Location - Roof of 45 Bacon St, Winchester, MA  (a) Garage Front  facing Ginn Rd  (b) Front of house  facing Bacon St    On November 22, 2017, siderails of portable ladders did not extend three-feet beyond the roof surface. Employees used a 24-foot aluminum extension ladder, with siderails that did not extend at least three-feet above the roof surface, to access the 6:12 pitch roof at 45 Bacon St., Winchester, MA, 01890. Employees were cleaning gutters from the roof of the two story residence at 45 Bacon St., Winchester, MA, 01890, without eye protection and were exposed to struck-by hazards posed by blowback from the leaf blower.
