29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: a) The Flats Housing Complex, Wilmington, DE - On or about December 6, 2017, the employer failed to ensure that appropriate personal protective equipment is worn to protect the skin from exposure to caustic chemicals. Employees who were not wearing gloves while engaged in masonry activities were exposed to caustic properties of Portland Cement.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59) a) The Flats Housing Complex, Wilmington, DE - On or about December 6, 2017, the employer failed to inform and train employees, who are exposed to hazardous chemicals while performing masonry activities, of the hazards related to the silica component of Portland Cement. Abatement Note: Information and training must be conducted in accordance with paragraph (h) of this section. Additionally, the training must address: * the hazards associated with exposure to Portland cement, including hazards associated with the cement's Cr(VI) and Silica content; * preventive measures, including proper use and care of PPE and the importance of proper hygiene practices; and * employee access to hygiene facilities, PPE, and information (including MSDSs).
