29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested at least annually and whenever a different respirator facepiece (size, style, model or make) was used: a) On or about December 14, 2017, the employer did not ensure employees required to wear tight fitting half-faced air purifying respirators were fit tested at least annually. b) On or about March 8, 2018, the employer did not ensure employees were fit tested when required to wear a tight fitting respirator with a different facepiece than was initially required, in that an employee went from a half faced respirator to a full faced respirator. Employees were required to wear tight fitting air purifying respirator when performing stone carving activities on sandstone which produces dust containing respirable crystalline silica. Employees were exposed to inhalation hazards that could result in health effects such as, but not limited to silicosis, lung cancer, COPD and kidney disease.

29 CFR 1910.1000(c): An employee(s) was exposed to respirable crystalline silica in excess of the 8-hour time weighted average limits of 0.204 milligrams per cubic meter of air listed in Table Z-3: On or about December 14, 2017, in a stone carving booth, an employee during stone carving was exposed to respirable crystalline silica concentrations at an eight-hour time weighted average of 1.55 milligrams per cubic meter of air which exceeded the OSHA PEL of 0.204 milligrams per cubic meter of air.
