29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system:  a) Mountain Shores Apartments: On June 23, 2017 and at times prior thereto employees performing concrete brooming activities on a third floor balcony were exposed to a 20 foot fall hazard.  The partial guardrail system that was in place did not provide fall protection for the employees along the outside edges and corners of the balcony.     b) Mountain Shores Apartments: On June 23, 2017 and at times prior thereto employees performing concrete brooming activities on a third floor balcony were exposed to a 20 foot fall hazard.  The guardrail system that was in place was missing a midrail.    Note) Abatement certification AND supporting documentation are required for this item.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:  a) Mountain Shores Apartments: On June 23, 2017 and at times prior thereto employees performed concrete brooming on a third floor balcony.  The employees did recognize the unsafe work practice and unsafe condition of walking backwards toward an inadequately guarded corner and edge.  The employees did not take action to minimize or eliminate the hazards.    Note) Certification and documentation of corrective action are required.

The employees did not recognize the fall hazard with the way the guardrail system was installed.  Employees did not take action to correct the hazard.
