29 CFR 1910.23(b)(7): Ladder surfaces are free of puncture and laceration hazards;  On or about December 16, 2017, employees were exposed to laceration and puncture hazards.  While using a ladder to access the upper level in the inedible food processing area.  The fixed ladder had rusted over time which created sharp jagged edges.

29 CFR 1910.23(b)(9): Ladders are inspected before initial use in each work shift, and more frequently as necessary, to identify any visible defects that could cause employee injury;  On or about December 16, 2017, employees were exposed to a fall of approximately 4 feet. Employees were using a 6 foot step ladder in the inedible foods room while the ladder was missing three of the four slip resistant feet and had not been inspected before each work shift for damage.

29 CFR 1910.23(b)(10): (10) Any ladder with structural or other defects is immediately tagged "Dangerous: Do Not Use" or with similar language in accordance with �1910.145 and removed from service until repaired in accordance with �1910.22(d), or replaced.  On or about December 16, 2017, employees were exposed to a fall of approximately 4 feet. Employees were using a step ladder in the inedible foods room while the ladder was missing three of the four slip resistant feet and was not tagged and removed from service.

29 CFR 1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed.    On or about December 17, 2017, the employer had not performed annual inspections of the hazardous energy control (lockout) procedure to ensure the requirements of the standard were being followed.  The employer did not ensure an inspection was conducted of each energy control procedure to correct any inadequacies or deviations in the procedure [per 1910.147(c)(6)(i)(B) requirements], and/or a review of each authorized employee and their responsibilities under the energy control procedure had been performed [(c)(6)(i)(C)].

29 CFR 1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.    On or about December 16, 2017, the employer did not ensure employees performing service and maintenance activities such as clearing jams were trained to recognize hazardous energy sources and had the means necessary to isolate and control them. Employees performing service and maintenance activities were only trained as affected employees not as authorized employees.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  On or about December 16, 2017, employees were exposed to the rotating parts of the long auger in the processing plant in the inedible food room. The barrier guards for the auger had been removed.  Fresh Mark was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1910.212(a)(1), which was contained in OSHA inspection number 1123249, citation number 1, item number 1 and was affirmed as a final order on 12/22/2016, with respect to a workplace located at 1600 Hartmont Avenue NE, Canton, Ohio 44705.
