29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems:  On or about April 14, 2025, employees of Fresh Mark, Inc. were exposed to a fall hazard of approximately 9 feet and 3 inches when climbing over an installed guard rail system and into the screw loader. Gaylord boxes are raised with a dump hoist to load meat and employees retrieve the plastic lining and/or other debris when it falls into the screw loader.  Fresh Mark, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.28(b)(1)(iii)(A), which was contained in OSHA inspection number 1649175, citation number 1, item number 1 and was affirmed as a final order on 5/11/2023, with respect to a workplace located at 1600 Harmont Ave. NE Canton, OH 44705.
